Act 150

OBRA Waiver

Pennsylvania’s Act 150 Program empowers mentally alert adults between the ages of 18 and 59 with physical disabilities to independently carry out essential daily tasks, including but not limited to eating, maintaining personal hygiene, and self-transportation.

To qualify for Act 150 Services, individuals must meet the following criteria:

Residency in Pennsylvania.

A level of care requirement equivalent to that of a Skilled Nursing Facility.

Fall within the age range of eighteen (18) to fifty-nine (59) years.

Demonstrate the ability to: a) Employ, terminate, and supervise attendant care worker(s). b) Manage personal financial matters. c) Handle legal affairs autonomously.

Exhibit the capability to direct their own care.

Possess a medically substantiated physical impairment anticipated to persist for at least twelve (12) consecutive months or result in mortality.

Go through the Medicaid (MA) program’s eligibility process and be deemed ineligible on financial grounds.

Participation in the Act 150 Program may incur a nominal co-payment, which is income-based and will not exceed the total service costs.

  • Personal Assistance Services
  • Personal Emergency Response System (PERS)

The OBRA Waiver is a program designed to provide Home and Community-Based services to individuals with developmental physical disabilities, enabling them to maintain their independence and live within their communities.

To qualify for this program, you should:

  • Be a resident of Pennsylvania.
  • Fall within the age range of 18 to 59. If you turn 60 while enrolled in the waiver, you can continue to receive services until they are no longer required. New applicants aged 60 and older will be referred to other programs.
  • Have a severe developmental physical disability that necessitates the level of care provided by an Intermediate Care Facility/Other Related Conditions (ICF/ORC).

Experience significant limitations in three or more major life activities, which may include self-care, communication, learning, mobility, self-direction, and capacity for independent living.

  • Meet the financial eligibility requirements determined by your local County Assistance Office.
  • Other related conditions (ORCs) encompass physical, sensory, or neurological disabilities that manifested before the age of 22 and are expected to be ongoing.

  • Respite
